1. Purpose

These General Terms of Use ("ToS") govern access to and use of the website www.bonopandas.com and the online ordering service (Click & Collect) offered by BoNoPandas.

3. Hosting

The site is hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA.

4. Site Access

The site is freely accessible to any user with internet access. BoNoPandas reserves the right to suspend or modify access to the site for maintenance or evolution without notice. All connection fees are at the user's expense.

5. Click & Collect Service

• Orders are to be picked up on-site at 14 rue Temponières, 31000 Toulouse, at the time slot chosen during ordering.
• Payment is made online at the time of ordering, via the Square secure platform (credit card, Apple Pay, Google Pay).
• Preparation time is approximately 15 minutes. The chosen slot is indicative and depends on kitchen workload.
• If the customer is absent at the chosen slot without prior cancellation, the order will be held aside for a maximum of 30 minutes before being discarded. No refund will be issued.
• The menu displayed online reflects our real-time stock. Some dishes may be unavailable depending on supplies.

6. Prices and Payment

Prices are shown in euros (€) including all taxes (VAT included). BoNoPandas reserves the right to modify its prices at any time. The prices applied are those in effect at the time of order validation.

7. Cancellation and Refund

• Any order can be cancelled free of charge by phone (+33 9 78 80 78 62) up to 30 minutes before the pickup slot.
• After this deadline, the order is in preparation and can no longer be cancelled.
• In case of a problem (error, missing dish, etc.), contact us within 24 hours. We will review each request on a case-by-case basis.

8. Loyalty Card

BoNoPandas offers a loyalty card managed by Square Loyalty. Registration is free and is done by phone number. The conditions for accumulating and using points are communicated upon registration. BoNoPandas reserves the right to modify the program conditions at any time, with prior notice to users.

9. Intellectual Property

All elements of the site (logo, photos, texts, design, source code) are the exclusive property of BoNoPandas or its partners. Any reproduction, even partial, without prior written authorization, is prohibited and constitutes a counterfeit punishable under articles L335-2 and following of the Intellectual Property Code.

10. Liability

BoNoPandas strives to provide accurate and up-to-date information, but cannot be held responsible for errors or omissions, nor for direct or indirect damages resulting from use of the site. In case of known food allergies, it is the customer's responsibility to notify us at the time of ordering.

11. Personal Data

Processing of personal data is detailed in our privacy policy, compliant with GDPR.

12. Applicable Law and Jurisdiction

These ToS are governed by French law. In case of dispute, and after an attempt at amicable resolution, French courts have sole jurisdiction.

13. Mediation

In accordance with Article L.612-1 of the French Consumer Code, in case of unresolved dispute, the customer has the option to freely refer the matter to the competent consumer mediator. European online dispute resolution platform: ec.europa.eu/consumers/odr.

14. Changes

BoNoPandas reserves the right to modify these ToS at any time. Modifications take effect upon publication on the site. It is recommended to consult this page regularly.
